Acceptance of Terms

By accessing and using the Edo Layers website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms constitute a legally binding agreement between you and Edo Layers regarding your use of our platform, marketplace, and workshop services.

Service Description

Edo Layers operates as a digital studio and marketplace specializing in Japanese ukiyo-e woodblock prints, offering authenticated original prints, contemporary reproductions, mokuhanga workshops, conservation services, and cultural content.

Our services include but are not limited to: art sales, educational workshops, conservation and framing services, licensing of digital images, and curatorial content about Edo period culture.

User Accounts and Registration

To access certain features of our services, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must provide accurate and complete information when creating an account and promptly update any changes to your information.

Purchasing and Payment Terms

All purchases are subject to acceptance by Edo Layers. We reserve the right to refuse or cancel orders at our discretion. Prices are subject to change without notice, but changes will not affect orders already confirmed.

Payment must be received in full before items are shipped. We accept various payment methods as indicated during checkout. All transactions are processed securely through encrypted payment systems.

Authentication and Authenticity Guarantee

For original woodblock prints, we provide authentication certificates based on scholarly research and expert evaluation. While we exercise due diligence in authentication, the art market involves inherent uncertainties.

Our authenticity guarantee covers the accuracy of our attribution and dating within accepted scholarly standards. Detailed provenance information is provided where available.

Shipping and Delivery

We ship worldwide using professional art handling services. Shipping costs and delivery times vary by location and item size. Insurance is included for all shipments above a specified value.

Risk of loss transfers to the buyer upon delivery. We are not responsible for delays caused by customs, weather, or other factors beyond our control.

Returns and Exchanges

Original artworks may be returned within 14 days of delivery if they are not as described. Items must be returned in original condition with all documentation. Return shipping costs are the buyer's responsibility unless the item was misrepresented.

Custom reproductions and workshop materials are generally not returnable unless defective. Digital products and services are non-refundable once delivered or commenced.

Workshop Terms and Conditions

Workshop registration requires advance payment and is subject to minimum enrollment requirements. Cancellations by participants must be made at least 48 hours in advance for a full refund.

Participants must follow all safety guidelines and studio rules. We reserve the right to remove participants who do not comply with workshop policies.

Intellectual Property Rights

All content on our website, including text, images, logos, and designs, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

Historical artworks in the public domain may be licensed for commercial use under separate licensing agreements. Contemporary reproductions and original content remain our intellectual property.

User Conduct and Prohibited Activities

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include but are not limited to fraud, harassment, and violation of intellectual property rights.

We reserve the right to suspend or terminate accounts that violate these terms or engage in inappropriate conduct.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, Edo Layers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services.

Our total liability for any claim related to our services shall not exceed the amount you paid for the specific service or product giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Edo Layers from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

This indemnification obligation survives termination of your use of our services.

Dispute Resolution

Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration in Tokyo, Japan, under Japanese law. Both parties waive the right to jury trial and class action proceedings.

Before initiating arbitration, parties must attempt to resolve disputes through good faith negotiation for at least 30 days.

Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of modified terms.

Material changes will be communicated to registered users via email or prominent website notice.
